TITLE: An act to regulate infecting individuals with self-spreading engineered pathogens.
PURPOSE: Assures that individuals will not be infected with engineered viruses and bacteria without their express consent.
JUSTIFICATION: Recognizes that infecting individuals with engineered viruses and bacteria without express consent impinges upon cherished civil and individual rights.
TEXT
No infection with engineered viruses without written consent.
A. No person may develop, release, or take part in causing the release of any self-spreading virus or bacteria without the express written consent of each individual that could potentially be exposed to the virus or bacteria.
B. The term “self-spreading virus or bacteria” shall mean any engineered virus or bacteria, including any recombinant, attenuated or modified version of any virus or bacteria, or any virus- or bacteria-like particles or substance, capable of spreading from person to person.
C. The term “release” shall mean any act that results in the actual or potential infection or transmission of or exposure to a self-spreading virus or bacteria.
D. Any person may bring an action to enjoin any violation of this section and to recover actual monetary loss or $5,000 for each violation of this section, whichever is greater.
