This bill assures that individuals will not be mandated to receive medical products if the manufacturer of the product cannot be sued for serious injury and deaths caused by the product.
The Bill
TITLE: An act to assure individuals are not mandated to receive liability-free medical products.
PURPOSE: Assures that individuals will not be mandated to receive medical products if the manufacturer of the product cannot be sued for serious injury and deaths caused by the product.
JUSTIFICATION: Increased confidence that manufacturers will ensure that medical products that are mandated are safe enough to not require the manufacturer to have immunity for injuries; and also recognizes that mandated medical products deeply impinge on cherished civil and individual rights, and hence at the least the manufacturer of a product must be liable for serious injuries and deaths before its product can be mandated.
TEXT
No liability, no mandate permitted.
- Notwithstanding any other law, a person may not be required by the state or any public entity in this state to take, be administered or otherwise receive or disclose whether the person has taken, been administered or otherwise received a medical product unless the manufacturer of the medical product is liable for any death or serious injury caused by the medical product.
- For the purposes of this section a “medical product” means any medical device, drug, or biologic.
